Welcome to Team Stradale (“Company,” “we,” “us,” or “our”). By accessing our website, registering for services, or participating in any program or event (each, an “Event”), you agree to be bound by these Terms & Conditions. If you are entering into this agreement on behalf of a corporate entity or racing team, you represent that you have the authority to bind such entity.

Motorsport activities are inherently dangerous. By participating in Arrive & Drive programs, coaching, track days, or managed services, you acknowledge that these activities involve significant risk of serious injury, death, and property damage.

–      You voluntarily assume all risks, known and unknown, associated with participation.

–      You agree to execute the Company’s standard Release and Waiver of Liability prior to any Event. Failure to execute a waiver does not negate the assumption of risk inherent in the activity.

–      You must adhere to all track regulations and staff instructions. We reserve the right to terminate your participation immediately, without refund, for conduct deemed unsafe or disruptive at our sole discretion.

–      Risk of Loss: The Risk of Loss remains with the Owner at all times. Team Stradale is not an insurer of your property. We are not liable for damage caused by fire, theft, flood, or “Acts of God” while the vehicle is in our care, custody, or control.

–      Insurance Mandatory: You must maintain a comprehensive insurance policy covering the vehicle for its full replacement value, including coverage for storage and paddock transit.

–      Standard of Care: Our liability for any damage to a bailed vehicle is limited to damage caused by our gross negligence or willful misconduct. We are not liable for “ordinary negligence” typical of high-stress motorsport environments.

Motorsport machines are subject to extreme mechanical stress and unpredictable failure.

–      While we perform services to industry standards, we do not warrant that a vehicle will be free from mechanical failure during high-performance use.

–      We are not responsible for component failures (e.g., engine, transmission, suspension) that occur on-track, regardless of recent service, unless such failure is the direct result of a documented service error.

In accordance with 815 ILCS 306, for any repair or maintenance exceeding $100:

–      We will provide a written or documented oral estimate.

–      We will not exceed the estimated price by more than 10% without your additional consent.

–      You have the right to request the return of replaced parts, provided the request is made at the time the work order is authorized.

–      Deposits: All Event and Service deposits are non-refundable unless otherwise specified in writing.

–      No Chargebacks: You agree that you will not initiate a credit card chargeback for any services rendered or for non-refundable deposits.

–      Default & Liens: We reserve a possessory lien on any vehicle or equipment in our possession for unpaid service or storage fees. If an account remains unpaid for 60 days, we may initiate abandoned vehicle or lien sale proceedings as permitted by Illinois law.

–      Event Changes: We reserve the right to cancel or reschedule Events due to weather, safety, or facility limitations. In such cases, a credit for future services will be issued; no cash refunds will be provided unless explicitly stated.

–      All digital assets on our website are our exclusive property. Unauthorized use for commercial purposes is strictly prohibited

–      You consent to Team Stradale using your name, voice, and image (including vehicle livery) in promotional materials, social media, and broadcasts.

To the maximum extent permitted by law, Team Stradale’s aggregate liability for any claim shall not exceed the total amount paid by you to the Company in the six (6) months preceding the claim excluding amounts paid to Team Stradale in connection with the purchase of a Motorsport vehicle. Under no circumstance shall we be liable for indirect, consequential, or “loss of use” damages (e.g., lost race entry fees, travel costs, or sponsorship revenue).

You agree to indemnify, defend, and hold harmless Team Stradale and its officers, employees, and agents from and against any and all claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your negligent or willful misconduct during an Event; or (c) damage caused by your vehicle to track facilities or third parties.

We reserve the right to update these Terms at any time. We will notify you of material changes via email or a prominent notice on our website. Continued use of our services after such notice constitutes your acceptance of the revised Terms.

By providing your email address and engaging with our services, you affirmatively consent to receive all notices, disclosures, and legal updates from Team Stradale electronically. You agree that all electronic communications satisfy any legal requirement that such communications be in writing

These Terms shall be governed by the laws of the State of Illinois. Any legal action arising hereunder shall be brought exclusively in the state or federal courts located or having jurisdiction in Will County, Illinois. You hereby waive any objection to the laying of venue in such courts.

These Terms, along with any specific Service Agreements or Waivers signed by you, constitute the entire agreement. If any provision is found unenforceable, the remaining provisions shall remain in full force.
